What Is MoCRA?

The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) was signed into US law on December 29, 2022 — the first major update to FDA’s authority over cosmetics in more than 80 years. It applies to all cosmetic products marketed in the United States, including those sold through e-commerce platforms like TikTok Shop.

Hair removal cream (depilatory cream) is classified as a cosmetic under the FD&C Act as amended by MoCRA. If you sell depilatory cream to US consumers — on TikTok Shop, Amazon, Shopify, or anywhere else — MoCRA applies to you.

What MoCRA Requires — For Sellers Like You

MoCRA places obligations on the “responsible person” — defined as the manufacturer, packer, or distributor whose name appears on the product label. If you private-label hair removal cream under your own brand, you are the responsible person for US sales.

Product Safety Substantiation

You must have adequate records demonstrating the product is safe under its labeled conditions of use. For depilatory cream, this means documented evidence of active ingredient safety (calcium thioglycolate concentration, pH range) and stability testing.

Compliant Labeling

Action required by you: Set up a customer contact channel and document any complaints received. Reports are submitted via FDA’s MedWatch or the Cosmetic Adverse Event Reporting portal. This is your responsibility as responsible person — not the manufacturer’s.

Facility Registration & Product Listing

Facility registration applies to establishments that manufacture or process cosmetics. As a private-label buyer who does not manufacture, this obligation falls on Guangzhou Daile Biotechnology as the manufacturing facility — not on you. Product listing with FDA is required and must be submitted by the responsible person (you, if your brand name is on the label) or the manufacturer on your behalf.
